Terms of Service

1. General

These terms and conditions apply to all services of Fairifai ("we", "us", "our") and all agreements we enter into with you for the use of our AI analysis services.

2. Definitions

• Customer: The natural or legal person who uses our services
• Services: All AI analysis services we offer
• Account: The user account created by the customer
• Reviews: Customer reviews that are imported by the customer

3. Offer and acceptance

Our offers are non-binding and valid for 7 days. An agreement is concluded by the customer accepting our offer. We confirm the agreement in writing.

4. Services

We offer AI analysis services for analyzing online reviews. Our services include:

• Import of reviews from various platforms
• AI analysis of review content and tone
• Dashboard with insights and statistics
• Technical support

5. Use of services

5.1 Customer obligations

• The customer ensures correct and complete registration data
• The customer is responsible for the confidentiality of their account
• The customer uses the services only for legitimate purposes
• The customer respects intellectual property rights

5.2 Prohibited use

• Sharing account data with third parties
• Using the services for illegal activities
• Disrupting the operation of our systems
• Copying or reverse engineering our software

6. Prices and payment

All prices mentioned are in euros and include VAT. Payment is made monthly or annually via automatic collection. In case of non-timely payment, we are entitled to suspend the services.

7. Delivery and availability

We strive for 99.5% availability of our services. We are not liable for temporary interruptions due to maintenance or technical problems.

8. Intellectual property

All intellectual property rights to our software, technology and content remain with us. The customer receives a limited, non-exclusive license for the use of our services.

9. Privacy and data protection

We process personal data in accordance with our privacy policy and GDPR. The customer guarantees that they are authorized to import and have reviews analyzed.

10. Liability

Our liability is limited to the amount the customer has paid in the past year. We are not liable for indirect damage or consequential damage.

11. Duration and termination

The agreement is entered into for an indefinite period. Both parties can terminate the agreement with a notice period of 1 month. Upon termination by the customer, the right to restitution expires.

12. Right of withdrawal

The customer has 14 days right of withdrawal from the conclusion of the agreement. If the services are used within this period, the right of withdrawal expires.

13. Disputes

Disputes are initially resolved through mutual consultation. If this fails, the Dutch court and Dutch law apply.

14. Changes

We reserve the right to change these terms. Changes are announced in advance. By continuing to use after changes, the customer is deemed to agree.
